The False Claims Act, 31 U.S.C. § 3729, a post-Civil War law inspired by cases of defense contracting fraud, was revitalized in 1986. Since then it has been used to sue both manufacturers and providers of pharmaceuticals. In some cases, these suits were meant to target offlabel marketing of pharmaceuticals. In 2009, the 11th Circuit rendered a decision in Hopper v. Solvay Pharmaceuticals that dramatically limits the ability of private plaintiff whistle-blowers to bring qui tam suits under the FCA for (...) such marketing. In June 2010, the Supreme Court denied certiorari, making the Circuit court decision final. The Solvay decision creates a significant barrier to certain kinds of qui tam suits, requiring the plaintiff to demonstrate the intent to market off-label, including by showing specific prescriptions that were written as a result of efforts to do so. A critique of what the author considers to be seriously flawed forms of cros cultural and comparative ethics forming the bulk of Wang's (1975) article on the ethics of Padmasambhava. The difficulties encountered are interpreted by Smu as both endemic to and programmatic for the work of comparative religion ethics.

Part one of this article introduces the conception of friendship and its connection with forgetfulness in Derrida and the Zhuangzi. Part two deals with the ethical focus of the discourse of friendship in Derrida and the Zhuangzi, which addresses the underlying relationship of oneself-other. Part three reveals how temporality and fleetingness are recognized as elements of friendship by Derrida and the Zhuangzi. While the Zhuangzi lacks the Derridean melancholic tone, this recognition helps both take the disruption, otherness and mourning of (...) friendship into account. Part four relates the Zhuangzian mutual forgetfulness of friends through effortless action (wuwei) to the Derridean criticism of classical friendship as ‘the second self’ and his assumption of difference, distance and disruption for friendship. Embracing these three ‘D’s’ leads Derrida to the structural ineluctability of forgetting to friendship. However, the Zhuangzi characterizes its ideal friendship in a style of simplicity, calmness, openness, desiring less and avoiding extremity, to emphasize naturalist suitability. (shrink)

The research study explores the philosophical viewpoints on cultural hybridity and considers how they affect the development of identities, moral behaviour, epistemological criticism, and real-world applications in a variety of fields. Cultural hybridity, which is defined as the blending of different cultural aspects, calls into question established ideas about identity and encourages us to reevaluate the flexibility and diversity that are fundamental to the human self. For measuring, the research study used the Smart PLS Algorithm Model related to variables through (...) this software run results included descriptive statistics, correlation coefficient, and the Smart PLS Algorithm Model between them. Philosophical investigations into cultural hybridity shed light on the dynamic interactions between identity and alterity, ethics and epistemology, and draw on the works of philosophers like Stuart Hall, Emmanuel Levinas, and Homi K. Bhabha. Cultural hybridity is an ethical imperative that requires us to shift our perspective towards the Other and welcome cultural variety with warmth and kindness. From an epistemological point of view, cultural hybridity upends hegemonic knowledge frameworks and creates pluralistic modes of knowledge creation that provide voice to underrepresented groups. Philosophical viewpoints on cultural hybridity have practical implications in urban planning, education, diplomacy, and intercultural communication. Overall result found that there is a direct and significant link between philosophical perspectives on the cultural hybridity related to dynamics of identity and alterity. These applications promote inclusive societies, social cohesion, and creativity. We began a revolutionary route towards a more globalized, compassionate, and linked society by accepting cultural hybridity. (shrink)

Increasingly, humanitarian organizations across the globe have been implementing innovative technologies in their practice as they respond to the needs of communities affected by conflicts, disasters, and public health emergencies. However, technological innovation may intersect with moral values, norms, and commitments, and may challenge humanitarian imperatives. Through the examination of an empirical case study on drone mapping, this paper aims to explore three questions: (1) What are the dynamics between aid delivery and technological innovation in the humanitarian enterprise? (2) How (...) are structural problems addressed in an environment in which technology is being portrayed as a force for change? (3) What moral responsibilities towards vulnerable populations should humanitarian stakeholders bear when introducing innovative technologies in humanitarian action. Discussion revolves around the ideology of “technological utopia”, and the normative role of technology in the aid sector - to make substantive impacts, or to produce “success stories”. In conclusion, a call for rigorous ethical analysis to help foster value sensitive humanitarian innovation (VSHI) is made. (shrink)

Através da educação escolar e de atividades comunitárias regulares, buscamos fornecer novas ideias e experiências práticas para a herança e inovação da cultura tradicional. Através da integração dos meios de comunicação modernos e das formas de arte, o conceito moral da música tradicional está ligado à sociedade moderna, formando uma nova ecologia cultural mais moderna e inclusiva. Ao fazer uso dos ricos recursos de pensamento moral da música tradicional chinesa, mostramos que o seu papel e valor insubstituíveis na educação moral e no cultivo da virtude. (shrink)

Recent years witnessed a growing interest in non-standard epistemic logics of knowing whether, knowing how, knowing what, knowing why and so on. The new epistemic modalities introduced in those logics all share, in their semantics, the general schema of ∃x◻φ, e.g., knowing how to achieve φ roughly means that there exists a way such that you know that it is a way to ensure that φ. Moreover, the resulting logics are decidable. Inspired by those particular logics, in this work, we (...) propose a very general and powerful framework based on quantifier-free predicate language extended by a new modality, which packs exactly ∃x◻ together. We show that the resulting language, though much more expressive, shares many good properties of the basic propositional modal logic over arbitrary models, such as finite-tree-model property and van Benthem-like characterization w.r.t.\ first-order modal logic. We axiomatize the logic over S5 frames with intuitive axioms to capture the interaction between the new modality and know-that operator in an epistemic setting. (shrink)

The discussion of collective agency involves the reduction problem of the concept of a collective. Individualism and Cartesian internalism have long restricted orthodox theories and made them face the tension between an irreducible concept of a collective and ontological reductionism. Heterodox theories as functionalism and interpretationism reinterpret the concept of agency and accept it as realized on the level of a collective. In order to adequately explain social phenomena that have relations as their essence, in this paper we propose a (...) relational, holistic account of collective agency and argue that functionalism and interpretationism can be integrated into such an account. Divergences and controversies are inevitable in the discussion of freedoms and rights, especially in the matter of reproduction. The Chinese first social egg freezing lawsuit raises the question: is the freedom to freeze eggs for social reasons justified because it is an instance of reproductive rights? This paper accepts social egg freezing as desirable reproductive freedom, but following Harel's approach and considering two theories of rights, the choice and interest theories of rights, we argue that social egg freezing is not (...) a reproductive right because one cannot justify a right or an instance of rights via merely describing the function of those instances that have been justified as right, that is, the choice theory lacks justifying normativity. Since reserving fertility and a suspension from reproduction do not serve reproductive ends per se, the sufficient reason for demanding social egg freezing as a right should be found in other ends rather than in right‐to‐reproduce, that is, the interest theory denies the demand as a right‐to‐reproduce. Permitting it on any grounds without guaranteeing adequate and accessible resources, especially in light of cross‐border reproductive care, raises serious questions about reproductive equality and violates the idea of reproductive rights. Therefore, any ground for social egg freezing should be weighed against whether more pressing reproductive needs, specifically those that are justified as rights, have been met. It would be social progress to shoulder these burdens for the vulnerable and then allow social egg freezing—if right‐to‐reproduce were not the only privilege of the few. (shrink)

The Reformation had a profound impact on hermeneutical practices by challenging ecclesiastical authority and emphasising interpretive freedom, addressing a crucial gap in historical theology. This study aimed to assess the influence of Martin Luther’s principle of self-interpretation of the Bible and Matthias Flacius’ organismic methodology, which builds on that principle, on the foundations of modern hermeneutics, particularly the methodological hermeneutics represented by Schleiermacher and Dilthey. Set within the context of the 16th-century Reformation, the study conducted a rigorous textual analysis of (...) historical theological documents, revealing a significant paradigm shift towards more inclusive and rational interpretations of sacred texts. This shift, aligning with emerging humanistic values, marked a lasting transformation in the field of hermeneutics.Contribution: The primary contribution of this study lies in its detailed exploration of the historical roots of modern hermeneutics, highlighting the Reformation’s pivotal role in shaping contemporary interpretive methodologies. By elucidating the connections between theological reforms and hermeneutical practices, this research enriches the discourse on the development of hermeneutics and underscores the enduring relevance of Reformation-era innovations. These insights provide valuable perspectives on the interplay between historical and contemporary hermeneutical theories, closely aligning with the intersection of historical theology and interpretive methodologies, thus offering a significant contribution to the field. In this article, we explicate evidence-based nursing (EBN), critically appraise its framework and respond to nurses’ concern that EBN sidelines the caring elements of nursing practice. We use resources from care ethics, especially Vrinda Dalmiya’s work that considers care as crucial for both epistemology and ethics, to show how EBN is compatible with, and indeed can be enhanced by, the caring aspects of nursing practice. We demonstrate that caring can act as a bridge between ‘external’ evidence and the other pillars (...) of the EBN framework: clinical expertise; patient preferences and values. Drawing on an influential EBN handbook, section 1 presents the aims and features of EBN, including the normative principle that EBN should take place within a ‘context of caring’. We aim to understand this context and whether it can be neatly detached from the EBN framework, as the handbook seems to suggest. In section 2, we highlight the grounds for resistance to EBN from the nursing community, before mounting the argument that nursing practices can be understood fruitfully through feminist care ethics and/or virtue ethics lenses. In section 3, we deepen that analysis using Dalmiya’s concepts of care-knowing and care as a hybrid ethico-epistemic virtue, which are ideally suited to the complex practices of nursing. In section 4, we bring this rich understanding of care into conversation with EBN, showing that its framework cannot be adequately theorised without paying proper attention to care. Caring can be neither an innocuous background assumption of nor an afterthought to the EBN framework. (shrink)

With the rise of the “humanitarian drone” in recent years, drones have become one of the most controversial public interest technologies that have gained increasing media attention. It is worth noting that, although there is a perception in the aid sector that drones hold the promise to reinvent the health supply logistics, to date, routine drone delivery is still relatively new and largely unproven. This paper presents a recent field study conducted in 2019, where drones were deployed in Malawi to (...) help address the last mile challenge in medical supply delivery, and where a noticeable mentality of “killing two birds with one stone” around the attempt of using drones in resource-poor settings is observed. The objective of the paper is to shed light, through a real-world case study and from the ethical perspective, on the impacts of implementing such a systemic change in the existing health supply chain systems. As conclusion, a call for more reflexive approaches for the critical examination, as well as more structured guidance for the responsible evaluation, of medical cargo drones is raised. (shrink)

Binarizing belief aggregation tackles the problem of aggregating individuals’ probabilistic beliefs on logically connected propositions into the group’s binary beliefs. One common approach to associating probabilistic beliefs with binary beliefs would be applying thresholds to probabilities. This paper aims to introduce and classify a range of threshold-based binarizing belief aggregation rules while characterizing them based on different forms of monotonicity and other properties.

Resumo: No contexto da “era da leitura de imagens”, a animação também é um produto moderno, e a animação chinesa sempre foi uma “transmissão de imagens por meio de imagens”. Os autores acostumaram-se a pegar emprestado desenhos animados de países, como o Japão ou países europeus, e sua criatividade no pensamento de animação foi bastante suprimida, o que é um golpe devastador. Ao rastrear a origem do pensamento de animação, a partir de uma perspectiva filosófica, a evolução do pensamento e (...) da expressão humana pode ser mais bem compreendida. Isso ajuda os pesquisadores a entender a evolução e as inovações da cultura humana e, assim, perceber melhor a relação entre cultura, arte e filosofia. O pensamento objetal enfatiza a divisão de problemas complexos em componentes menores, ou seja, os objetos. Na animação, isso pode ser interpretado como a divisão de cenas e ações complexas em objetos, personagens e elementos separados. Essa abstração e correlação de objetos ajudam os animadores a entender e projetar melhor as interações entre os personagens, o movimento dos objetos e a dinâmica da animação geral. Embora o estudo do “pensamento Xiang” tenha se desenvolvido na história da filosofia, ele não está diretamente relacionado ao rastreamento do pensamento de animação e à reconstrução artística. De fato, ele tem um impacto significativo no pensamento da animação. Por meio da análise do texto filosófico das obras de animação, os pesquisadores podem descobrir os temas filosóficos, os símbolos e os significados da animação. Isso pode incluir a interpretação de um trabalho de animação específico e como determinados pensamentos filosóficos são expressos, por meio da narrativa, dos personagens, dos elementos visuais etc. Portanto, o estudo do pensamento objetal tem um significado prático importante, para explicar a singularidade do pensamento de animação. It is widely agreed that reactive attitudes play a central role in our practices concerned with holding people responsible. However, it remains controversial which emotional attitudes count as reactive attitudes such that they are eligible for this central role. Specifically, though theorists near universally agree that guilt is a reactive attitude, they are much more hesitant on whether to also include shame. This paper presents novel arguments for the view that shame is a reactive attitude. The arguments also support the (...) view that shame is a reactive attitude in the sense that concerns moral accountability. The discussion thereby challenges both the view that shame is not a reactive attitude at all, suggested by philosophers such as R. Jay Wallace and Stephen Darwall, and the view that shame is a reactive attitude but does not concern moral accountability, recently defended by Andreas Carlsson and Douglas Portmore. (shrink)
